I think I've occassionally seen this and have come back later and seen the Waypoint once again acknowledge that I have an instance, without buying a new one. I can't really remember for certain or what I did.
It sucks but it's not a huge issue unless it's something in the price range of HoH
If you have the pc capacity you could leave another toon hanging out in the area.
